Recently, Hon'ble DHC has held that ex-CEstat cannot practice before the cestat.

 

Should a similar prohibition apply to the ITAT. There are pros and cons.

 

I personally feel that they have so much to offer in terms of expertise, experience etc that it would be a shame if their expertise is not used by the ITAT.

 

The reverse view is that they may influence the Bench with their position.

 

However, I feel the risk is overdone.
